brad m. tomtishenMr. Tomtishen has over thirty-five years of experience serving primarily as counsel to clients involved in tax intensive business transactions.

While Mr. Tomtishen has concentrated his practice in matters of federal taxation, he also has extensive experience advising organizations and individuals with respect to all aspects of business transactions.  He has served as counsel to real estate developers in connection with syndications, negotiation of joint venture and partnership agreements, acquisitions, financings and tax planning.  Since 1993, Mr. Tomtishen has represented a major syndicator with respect to offerings of interests in its low-income housing tax credit funds and the acquisition of interests in hundreds of tax credit properties by those funds. He has also represented developers and a state housing finance agency in matters involving the low-income housing tax credit.  He is currently a co-chair of the Tax Credits and Equity Financing Committee of the Forum of Affordable Housing and Community Development of the American Bar Association.

Mr. Tomtishen has acted as bond counsel, special tax counsel, underwriter’s counsel and borrower’s counsel in various tax-exempt financing transactions, including particularly financings in the hospital and health care industries.  He was one of the principal attorneys involved in obtaining the first rulings from the Internal Revenue Service regarding the tax and tax-exempt financing implications of joint ventures among tax-exempt hospitals.  He also has advised health care clients generally as to matters relating to tax-exempt status and the unrelated business income tax.

Brad M. Tomtishen graduated cum laude from the University of Michigan in 1983 with a Juris Doctor degree and a Master of Arts degree in applied economics.  He received his undergraduate degree from Oakland University in 1979 in management with a concentration in accounting.  Mr. Tomtishen passed the Certified Public Accountant examination in 1979.  Mr. Tomtishen was admitted to the State Bar of Michigan in 1983 and The Florida Bar in 1992. Mr. Tomtishen has lectured on various tax topics and has authored articles appearing in publications including The Tax Exempt Organization Law Review, the Michigan Tax Lawyer and the Michigan Bar Journal.  Mr. Tomtishen has been named to The Best Lawyers in America for the past 10 years.
